Mai D. Luu is an experienced litigation attorney admitted to practice law in California. Mai practices family law exclusively in Santa Clara County. Prior to joining Luu Law, Mai was the managing partner of Stramaglia Luu, LLP, a boutique litigation firm specializing in complex family law litigation. Mai handles all aspects of family law representation, including dissolution, parentage, property agreements, child custody, visitation, support, property division, post-dissolution concerns, and post-judgment relief. Mai often handles contested high conflict custody and visitation proceedings that may include Ex Parte proceedings, temporary emergency requests and orders, move away requests, and domestic violence restraining orders. In resolving disputes concerning property interests, Mai assists clients that have interests in closely-held businesses and corporations, real property holdings, and other financial assets gained prior to marriage, during dissolution and post-judgment proceedings. In cases that require outside help, Mai often collaborates with experienced forensic accountants, business evaluators, real estate appraisers, and mental health professionals.
Mai is also qualified to serve as Minor's Counsel, where she may be appointed by the Court to represent minor children in high conflict custody and visitation proceedings. In order to serve as a court appointed attorney for children, Mai has complied with the California Rules of Court which require all attorneys to be specially trained, educated, and have the requisite child custody experience to qualify as a Minor's Counsel. A Minor's Counsel is appointed to work diligently on all appointments by the Court to represent children in high conflict custody disputes and must carefully navigate issues that often come with divorce, such as child abuse, neglect, and other difficult issues that are often associated with contested child custody or divorce cases. Minor's counsel is a voice for the child, without compromising the child's rights, emotional well-being, or forcing the child to side with one parent or the other. Once assigned, Mai continues to represent the minor until the child reaches the age of 18 or when the court may choose to end the appointment early. As a minor's counsel, Mai must work closely with the Court, Family Court Services, and all parties involved in the case in order to consider what is in the best interest of the child. Mai frequently volunteers as a Settlement Attorney and Judge Pro Tem in Family Court and handles MSCs and SOCS.
Mai is an active member of the Santa Clara County Bar Association, in which she is also a member of the the Family Law Section. Mai previously served on the SCCBA Judiciary Committee and was also active on the Diversity Committee. Mai is a qualified panel attorney on the SCCBA and previously participated on the modest means panel, assisting clients of limited means with their family law cases once they have been referred by the SCCBA. Mai has also served as a volunteer attorney at SCU’s Katharine & George Alexander Community Law Center and VABANC pro bono legal clinic, which are held monthly. In 2012, Mai was honored as the Vietnamese American Bar Association of Northern California's Trailblazer recipient for her pro bono leadership efforts during the BP Deep Horizon Oil Spill and Hurricane Katrina in the Gulf. Mai was the 2009 Rising Star Unity Award Recipient recognized by the San Francisco Minority Bar Coalition for her pro bono efforts and leadership.
Mai earned her Bachelor of Science in Management from Tulane University and earned her J.D. from Loyola Law School in 2002. Mai obtained her LLM in International Legal Studies from Golden Gate University School of Law with an emphasis on International Business Transactions. Mai is admitted to the State Bar of California and the State Bar of Hawaii. Mai is a member of the Hawaii State Bar Association. Prior to devoting her practice exclusively to family law, Mai practiced in the areas of probate, corporate, and immigration law. Mai previously served as a board member of the American Red Cross, Silicon Valley Chapter, and is also an advisory member of the Asian Law Alliance.
