I-751 Battered Spouse Waiver Petition to Remove Conditions on Residence Waiver GRANTED
August 10, 2016
In an August 2016 decision, USCIS approved form I-751 Waiver based on abuse or battering by the U.S. Citizen Spouse. The approval came without a Request for Evidence or a request for an interview.
Our client had a bona fide marriage. She was also a victim of domestic violence and deportation threats by her U.S. spouse. Her US spouse was controlling and physically abusive toward client. Our firm assisted client to obtain a restraining order against her abusive spouse. We also gathered extensive evidence to document the abuse. Her I-751 Petition was approved within one year. Client received her permanent resident card in August 2016.
